Agreement to Terms
By accessing or using Pawly ("the Service") at fetchpawly.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
The Service is intended for use by individuals in the United States and is governed by U.S. law. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. You may not use or export anything from the Service in violation of U.S. export laws or regulations.
Description of Service
Pawly is a pet health passport and tracking platform. It allows you to record vaccinations, medications, vet visits, and documents for your pets; organize pets and people into households; share access with family or sitters; and receive reminders for due items. Some features may require a paid subscription.
Account and Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your password and for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
You are responsible for any loss, damage, or additional costs that you, Pawly, or others may incur as a result of your submission of false, incorrect, or incomplete information. We are not obligated to verify the identity of users.
Subscriptions and Payments
Pricing and structure. Current subscription plans, pricing, and included features are described on our pricing page. Household subscriptions are billed annually. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
What's included. Subscription benefits (e.g., household invitations, pet sharing, document uploads) are described on the pricing page and may vary by plan. We reserve the right to add, modify, or remove features, or to introduce new plans or tiers, at any time. Changes that materially reduce the value of your subscription will be communicated with reasonable notice where practicable.
Renewal and cancellation. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. If you cancel, you retain access through the end of your paid period. Cancellation instructions are available in your account settings.
Refunds and price changes. Fees are non-refundable except as required by law or as stated in our refund policy. We may change subscription prices with reasonable notice (typically at least 30 days before the next renewal). Continued use after a price increase constitutes acceptance of the new price.
Failed payments. If a payment fails, we may suspend access to subscription features until payment is resolved. You are responsible for keeping your payment method current. We will attempt to notify you of failed payments.
Pricing errors. We strive for accuracy but are not responsible for misprints or errors in pricing or feature descriptions. Our sole obligation in the event of a pricing error is to correct the error. We reserve the right to change any pricing, features, or product details at any time.
Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Upload malicious software, viruses, or harmful content
- Attempt to gain unauthorized access to our systems or other users' accounts
- Share content that infringes intellectual property or others' rights
- Abuse, harass, or harm other users
- Resell or redistribute the Service without permission
Your Content
You retain ownership of the data you upload (pet records, documents, etc.). By using the Service, you grant us a limited license to store, process, and display your content as needed to provide the Service. We do not claim ownership of your data.
The Service is not designed as a disaster recovery or backup facility. You should maintain your own backup copies of all important data. We are not liable for any loss or deletion of your content, whether caused by technical failure, unauthorized access, or otherwise.
Termination
You may close your account at any time. We may suspend or terminate your access if you breach these Terms or for other reasons at our discretion. Upon termination, your right to use the Service ceases. We may retain certain data as required by law or for legitimate business purposes.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Pawly is a record-keeping and reminder tool—it is not a substitute for professional veterinary advice. Always consult a licensed veterinarian for medical decisions about your pets. We do not guarantee uninterrupted or error-free service.
Reminders (including vaccination and medication reminders) are provided for convenience only and are not guaranteed to be delivered on time or at all. Service downtime, technical failures, email delivery issues, or other factors may cause reminders to be delayed or missed. You are solely responsible for your pets' care and for ensuring medications and vaccinations are administered according to your veterinarian's instructions. We are not responsible for any harm, injury, illness, or other damage to pets that may result from missed reminders, service unavailability, or reliance on the Service.
Use of the Service requires a compatible device, internet access, and may require software updates. You are solely responsible for maintaining your devices and connectivity. Your ability to use the Service may be affected by factors beyond our control, including hardware, software, or network performance.
Limitation of Liability
To the maximum extent permitted by law, Pawly and its operators, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or harm to pets or other animals arising from your use of the Service.
This limitation applies to all claims, including those arising from data breaches, unauthorized access, service interruptions, or the discontinuation of the Service (including due to insolvency, bankruptcy, or business closure). It also applies to any harm, injury, illness, or damage to pets—including harm resulting from missed or delayed reminders, service downtime, technical failures, or your reliance on the Service for medication, vaccination, or other care schedules. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.
Release
You hereby release, remise, and forever discharge Pawly and its operators, directors, employees, agents, affiliates, licensors, and service providers from any and all claims, demands, causes of action, liabilities, and damages (whether known or unknown) arising from, related to, or in connection with your use of the Service, including without limitation claims relating to data loss, service interruptions, third-party conduct, or harm to pets. If you are a California resident, you waive California Civil Code Section 1542, which states: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release."
Indemnification
You agree to indemnify, defend, and hold harmless Pawly and its operators, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your content or data; (c) your violation of these Terms; (d) your violation of any third-party rights; or (e) any harm to pets or others resulting from your use or misuse of the Service. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you.
Third-Party Services
The Service may integrate with or link to third-party services (e.g., payment processing, email delivery, maps). We are not responsible for the availability, accuracy, or conduct of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.
Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government actions, labor disputes, power outages, internet or telecommunications failures, or cyberattacks. Such events may result in service interruptions without liability to us.
Service Continuity and Business Changes
We do not guarantee that the Service will be available indefinitely. We may discontinue the Service, in whole or in part, at any time with reasonable notice where practicable. This includes discontinuation due to business closure, insolvency, bankruptcy, merger, acquisition, or other circumstances beyond our control.
In the event of bankruptcy, insolvency, or business closure, we will use reasonable efforts to provide advance notice and a data export opportunity where legally and practically feasible. However, we cannot guarantee such notice or export capability. Prepaid subscription fees are generally non-refundable, including in the event of service discontinuation or bankruptcy. You are responsible for maintaining your own backups of important data.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
Governing Law and Disputes
These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
Any claim or cause of action arising from or relating to these Terms or the Service must be commenced within one (1) year after the claim or cause of action arises, after which time such claim or cause of action is forever barred.
General Provisions
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pawly regarding the Service and supersede any prior agreements.
No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Survival: Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, release, and governing law) shall survive termination of these Terms or your access to the Service.
Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without your consent.
